المملكة: Penalties amount to cancellation… 7 requirements for licensing the customs consulting profession

The Zakat, Tax and Customs Authority has set the controls for the customs consulting profession, which aim to clarify the requirements that must be met to obtain a license, cases of license revocation, penalties for anyone who violates its provisions, controlling and monitoring customs consulting activity, and managing and organizing the relationship between the Authority and practitioners of the customs consulting profession. In order to raise the level of sector efficiency.
The requirements for a license to practice the profession include that the applicant must be of Saudi nationality, must be dedicated to working in the profession, and must have at least a bachelor’s degree from an accredited university or college in the Kingdom or any other certificate from outside the Kingdom equivalent from the Ministry of Education, with the necessity of having Experience related to or related to the nature of work for a period of no less than three years after obtaining a bachelor’s degree, with passing the professional test determined by the Authority.

The Authority obligated the licensee to report its headquarters, notify it if it changes within a period not exceeding 14 days, adhere to the regulations and instructions issued by the Authority or the relevant authorities, and notify the Authority within 5 working days if the licensee establishes a professional company or participates in it.

Keep submitted papers

It required the licensee to keep papers submitted by customers, work papers, and copies of customs consultations provided to others, provided that they be kept for a period of no less than 5 years, taking into account the other statutory periods stipulated in the relevant regulations, and taking into account the requirements of good professional conduct and credibility with others, and the Authority has the right to To issue any rules or instructions to the licensee in this regard.
The licensee is obligated to attend any courses or training programs specified by the Authority, to maintain the privacy and confidentiality of customer information and data, and not to disclose any information related to them.

Cessation of practicing the profession

It obliges the licensee, if he stops or is suspended from practicing the profession for any reason, temporarily or permanently, to inform the Authority of this within 30 days from the date of his cessation or suspension, and the Authority suspends the license until he submits an application to resume practicing the profession, provided that the period of suspension does not exceed 365 days or the expiration of Validity of the license – whichever is earlier – otherwise the license will be considered invalid. Provide any other data related to the license requested by the Authority.
The Authority confirmed that the licensee is responsible for compensating others for damages arising from errors resulting from his practice of the profession.
If the licensee violates the provisions of these controls, the licensee shall be punished with a warning, suspension of the license for a temporary period determined by the Authority not to exceed 60 days, or cancellation of the license, as well as summoning the licensee to hear his statements before imposing the penalties mentioned in Paragraph “1” of this article.
