The Ministry of Human Resources confirmed that an applicant whose application has previously been rejected may not submit a new license application unless one year has passed from the date of rejection.
The Ministry prohibited the licensee from providing the following activities: housing workers, training and qualifying workers, or providing support services, for example, “home maintenance – health care activities – social activities,” or providing expertise and consultation in the field of management.
It is stipulated that investment in supporting activities does not exceed 25% (twenty-five percent) of the paid-up capital.
It also stressed that he must not have been convicted of a crime against honor or trust, or any of the violations related to the provisions regulating child protection or the provisions related to trafficking in persons, unless he has been rehabilitated, and that he must not have previously obtained an independent license or been a partner in A company to practice any of the activities mentioned in these rules and the license was revoked by a judicial decision or ruling as a penalty based on these rules or any other system, unless at least five years have passed.
It obliges the licensee, when advertising any service, to include in the advertisement his name, logo, any distinctive statement, contact information, a statement of the name of the advertised service, a clear statement of the cost to customers, and the use of license data on the institution’s publications and seals.
It prohibited the licensee from submitting an advertisement that includes a false offer, statement, or claim, or that it is formulated in terms that would directly or indirectly lead to deceiving or misleading the customer, or an advertisement that does not take into account the regulations related to human rights and human trafficking regulations, or provide a product that violates privacy. Social, religious or public morals.
Handling complaints
It required the licensee to establish a channel to receive, document, and process complaints from workers, employers, or customers, adhere to the procedures guide on the platform for dealing with complaints and resolving complaints according to the specified period, and publish information about how and where to submit complaints to customers and other interested parties.
It obligated the licensee to provide a detailed guide to clarify the information and data necessary for the customer to explain the mechanism for submitting the complaint and following it up in the licensee’s building and its branches, and to include it on the “approved platform/website/application” or any of the company’s social media accounts, and to provide a copy to customers if they wish to obtain it. It has writing on it.
The competent agency shall establish procedures for resolving the complaint on the approved platform, specifying the period for closing the complaint and the penalties for the licensee’s delay or failure to address this complaint and his non-compliance with the platform’s procedures, provided that these procedures include warning penalties, suspension periods, and withdrawal of the license.
She explained that in the event of suspicion of a violation by the licensee, or in the event of a request to investigate the violation, the agency or whomever it delegates may take one or more of the following measures: warn the licensee, and temporarily stop an activity, or more of the activities and services that the licensee is permitted to do. By practicing it, or suspending the services of the Ministry and the relevant authorities provided to the licensee for a period of 30 days, which may be extended for a period or similar periods in the event of the licensee’s non-compliance, withdrawal of the bank guarantee, and withdrawal of the license.
