المملكة: Municipalities increase fines: 100,000 for vandalizing facilities and 3,000 for dumping waste
The law requires the violator to compensate for all damages sustained by the facility, including the costs of repairing the damage. In the event of multiple violators, they jointly bear the value of the penalty, with the possibility of referring them to the competent court.
The rules, approved by the Minister of Municipalities and Housing, Majid Al-Hogail, obligated the competent authority to enable the violator to repair the damage under its supervision or to carry out the repair at his expense and to collect the costs in accordance with the state revenue system.
Violators will be fined
According to the rules, the competent authority has the right to oblige the perpetrator of the violation to repair what results from his violation under its supervision, or to carry out the repair at the expense of the violator and return to him all the costs and expenditures necessary to remove the violation and repair the damages that resulted from it. If he does not pay them, they are collected according to the state revenue system.
The rules stipulate that anyone who damages road extensions or flood channels while carrying out work for public facilities without a license will be fined 10% of the repair costs. In the event of a license, the fine will be 5%, with a maximum of 100,000 riyals.
The rules also fined anyone who illegally uses roads or flood channels or creates cuts or holes in them, equivalent to the costs of removing the encroachment, up to a maximum of 50,000 riyals.
The penalties included a fine of 3,000 riyals for anyone who throws petroleum materials or dust on roads, and a fine of 2,000 riyals for anyone who facilitates others to benefit from roads or flood channels illegally.

In the event of a repeat violation, the fine shall be doubled to a maximum of twice the maximum stipulated maximum, and the compensation or fine decision shall be issued by the head of the competent authority.
A fine of two thousand riyals will be applied against anyone who facilitates others to benefit illegally from the road or flood drainage channels. In the event of repetition of any of the violations mentioned in these rules, the fine will be doubled, provided that it does not exceed twice the maximum limit prescribed for the fine.
Damage repair
The Ministry obligates the perpetrator of the violation, or his subordinate, as the case may be, to pay all costs and expenses necessary to remove the infringement, repair the damages resulting from the violation, and restore the situation to what it was before.
The rules stipulate that the entities, departments, and companies concerned with the management of any public facility are obligated to provide the facility’s plans and instructions prepared for its protection to those concerned who request them, and they are responsible for the accuracy of the instructions and plans they provide.

It stressed that if it is incorrect, it will be fully responsible for repairing the resulting damage, if the damage results from work for which it has been licensed.
The regulations stated that the costs of removing the damage and repairing the consequences of the violation to restore the situation to what it was before, are estimated according to the prices of the contracts concluded by the competent authority to implement or maintain the facility that was damaged.
She stressed that collecting fines and compensation does not prevent the completion of the necessary procedures to refer the violator to the competent court to impose the prison sentence stipulated in Article Five of the Public Facilities Protection System.
The regulation noted that a grievance may be made against the committee’s decision regarding a fine or compensation before the Administrative Court within 60 days from the date of learning of the decision.
