"Sharjah Consultant" The draft law regulating judicial fees allows

Sharjah, June 15 / WAM / The Consultative Council of the Emirate of Sharjah authorized the draft law regulating judicial fees in the Emirate of Sharjah, during its 16th session held yesterday at its headquarters in the city of Sharjah as part of its work for its second regular session of the eleventh legislative chapter.
The Council started its session by ratifying the 15th session of the session, then began to discuss the draft law and the report from the Legal and Legislative Affairs Committee, appeals, suggestions and complaints in the council regarding the project, which was prepared by the committee after extensive studies and intensive specialized meetings.
The session was attended by Sheikh Faisal bin Ali bin Abdullah Al -Mualla, Secretary -General of the Judicial Council in the Emirate of Sharjah, and His Excellency Counselor Dr. Issa Saif bin Hanadel, Director of the Legal Department of the Sharjah Government, along with a number of their aide.
Counselor Dr. Issa Saif bin Hanadel said that the draft law comes as a complement to the law of the judiciary, which came into effect from the first of June and sets the general rules for establishing an independent judicial authority added to the executive and legislative authorities who have existed since 1999 AD in line with the vision of His Highness Sheikh Dr. Sultan bin Muhammad Al Qasimi, Member of the Supreme Council and Ruler of Sharjah in establishing the independence of the judiciary and ensuring the rule of law.
He explained that the draft law organizes the structure of the judicial fees that the courts are fulfilled, controls the procedures for imposing, collecting and exemptions, and achieving a balance between the procedural, justice and financial aspects to ensure the provision of distinguished judicial services that take into account the social and economic conditions.
Muhammad Saleh Al Ali, a member of the Legislative and Legal Affairs Committee, recited the report on the draft law, which included a comprehensive review of legal articles and the committee’s recommendations regarding it, in addition to studying the legal and financial aspects and the extent of the project compatibility with related laws and regulations.
The report emphasized that the draft law contributes to enhancing transparency, controlling financial transactions in the courts, and organizing the relationship between litigants and the judiciary.
Muhammad Ali Jaber Al -Hammadi, Chairman of the Legislative and Legal Affairs Committee, provided an explanation of the aspects of the committee’s observations on a number of amendments that contribute to strengthening the articles of the bill.
The session witnessed the members of the Consultative Council offered accurate observations and constructive proposals that dealt with various legal and procedural aspects in the draft law and the importance of clear mechanisms for collecting fees and the need to link the fees to the nature of the issue and their type and the development of collection tools in a way that takes into account speed and accuracy and the litigants avoid additional financial burdens.
During the session, the Council reviewed the articles of the draft law, which aim to regulate judicial fees due to cases of all kinds, documentation and electronic payment fees, as well as general provisions related to exemption, and fees are completely or partially.
