Abu Dhabi Commercial Court issues a ruling to stop the infringement of a global brand

Abu Dhabi, July 9 / WAM / The Abu Dhabi Commercial Court issued a judicial ruling to stop the infringement of a famous global brand working in the field of fashion and e -commerce, after it was proven that the brand illegally used inside a store in the country without obtaining permission or license.

The company that owns the brand had filed a lawsuit calling for the closure of a store that used its name and its trademark on its offers offered, the shops and advertising materials, in addition to promoting it via social media platforms, which caused the public to mislead the source of the products, and its delusion that the store is affiliated with the original brand, which depends on its activity on electronic sales exclusively without the opening of actual stores.

The ruling came after a series of pleadings before the various judicial grades, as the Commercial Court approved the right of the brand to protect his mark from illegal use, stressing that the infringement of registered brands is a violation of the laws in force in the UAE and international agreements in the field of intellectual property rights.

The court ruled to stop the assessment work on the registered global brands, and to remove the imitated trade name from the records of the Department of Economic Development in Abu Dhabi and from all commercial records in the country and prevent the aggressor store from using these brands in any way, whether by using them in the commercial name or through any electronic or social means, and obliging him not to sell any products that carry these signs and remove products, materials, banners, symbols and materials Advertising that carries these signs of the store.

The ruling was appealed, and by challenging it before the Court of Cassation, it ruled not to accept the appeal, so that the ruling issued by the Commercial Court will be final and the duty to implement.

The Commercial Court establishes this judiciary, a principle that enhances the confidence of investors and international companies in the UAE judicial system, and the speed of its response to such cases with a great economic impact.
