Mohammed bin Rashid issues the law to organize contracting activities in the Emirate of Dubai

Dubai, July 12 / WAM / in line with Dubai’s entrepreneurial vision in developing and organizing vital sectors to keep pace with international best practices, His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister, may God preserve him, as ruler of Dubai, issued Law No. (7) of 2025 regarding the organization of practicing contracting activities in the Emirate of Dubai, which is considered a qualitative step to enhance the legal and jurisprudence framework for the contracting sector.

This law aims to unify and regulate the practice of contracting activities at the emirate level, and to lay clear foundations for the classification of contractors commensurate with their expertise and their financial, technical and administrative capabilities, in a manner that ensures the application of the highest quality and professional standards, and enhances transparency and coordination between the competent authorities, which supports the ambitious development process of the Emirate of Dubai and keeps pace with its urban and economic development requirements, and corresponds to Standards, structural requirements, planning and urban planning in the emirate.
The law stipulated that it be formed in the Emirate of Dubai by a decision of His Highness the President of the Executive Council, a permanent committee called the “Contracting Construction and Development Committee”, headed by a representative of the Municipality of Dubai and a membership representing representatives of the specialized authorities and the concerned authorities in the emirate, as the law defines the competencies of the committee, the most important of which are: the adoption of the contracting of the contracting in Dubai, and the identification of the competent authority. To supervise each of these activities in accordance with the jurisdiction established by each party, supervising the application of the provisions of this law and decisions issued by it, as well as proposing policies and legislation organized to carry out the contracting of the contracting, and submit them to the specialized authorities in the emirate to take what is necessary for them.
The committee’s competencies also include the solution to any dispute that may arise between the authorities specialized in the right to supervise the contracting of the contracting in the emirate, the adoption of a list of behavior and morals to practice the contracting of contracting in Dubai, and coordination with the various public and private bodies in all matters related to the practice of contracting contracting in the emirate, and studying recommendations and proposals brought to them From the specialized authority, which the law has known as it includes the municipality of Dubai and any governmental authority that is legally specialized in supervising and controlling any of the contracting construction in the emirate, and directing what it deems appropriate regarding these recommendations.

The range of application.
The scope of the implementation of this law, which is published in the official newspaper, and works with it after six months of the date of its publication, includes all contractors working in the Emirate of Dubai, including special development areas and free areas, including the Dubai International Financial Center, and also includes all contracting construction, to be excluded from the provisions of this law, contracting activities related to airports and infrastructure And its facilities, and any contracting activity that is decided to be excluded from the provisions of this law by a decision of His Highness the President of the Executive Council of the Emirate of Dubai, based on the recommendation of the committee.
Municipal terms of reference.
The law also detailed the competencies of the Dubai Municipality related to its purposes, foremost of which is the establishment of a unified electronic system at the level of the emirate, its operation, management, supervision and modernization, and linking it with the “Invest in Dubai” platform in a way that ensures the development of the registration, evaluation and classification system for the contracting of the contracting of the contracting in the emirate, in addition to the establishment and organization of the registry, which is an electronic file for registration of private data With the contractor, the activity of the contracting allowed to be practiced, its classification category, its technical staff, and any other data that sees the “Contracting Construction and Development Committee” the importance of its inclusion in it, and the update of its data, ensuring the existence of a comprehensive database in the emirate for the contractors, and the activities of the contracting that are allowed to practice it.
The specialties of Dubai Municipality also include the preparation of a list of behavior and ethics to carry out the contracting of the contracting in the emirate, submitting it to the committee for approval, and the rehabilitation and classification of contractors practicing the activities of construction, construction and demolition of buildings, and the issuance of professional competence certificates for the technical staff of contractors who are practicing the activities of construction and construction contracts.

Conditions for registration of the contractor.
The law set the conditions for registration of the contractor in the registry, the registration procedures, the duration of the registration, which is one year that is renewable for a similar extend, and the cases in which the contractor may be removed from the record,

The law also provided the contractors ’obligations, the most important of which are: commitment to the legislation that is valid in the Emirate of Dubai, including construction, planning, environment, health, public safety and professional safety, and providing all criteria, conditions and requirements on which it is classified as its classification period, and not to use any person who is not restricted in the record and does not have a certificate of competence. The profession, as well as adherence to the limits of contracting activity and the permissible specialization for its practice and the limits of the classified category.
The law obligated the contractor not to contract to implement projects that exceed its financial, artistic or administrative estimates, or exceeding the number of technical cadres and employment available to him, in addition to adhering to the provisions and conditions of the contracting contract, and the instructions of the engineering office appointed by the employer, and not to exploit his license, class or classification to implement photo projects in favor of others, with the intention of obtaining benefits Or achieve special interests.
The contractor must also carry out the contracted works by himself, through the technical staff available to him, and he is not permissible to assign these works to others, except in accordance with the conditions stipulated in this law, and after obtaining the approval of the competent authority, while the law has detailed the cases in which the contractor may assign some of the contracting work to another contractor, as the law authorized the formation of a coalition between more than one coalition A contractor for the implementation of one project, and he mentioned the conditions related to that, the most prominent of which is that the nature of the project require the formation of the coalition, whether in terms of its size, its material, human or financial resources, or the specializations required to implement it, or the time period needed to accomplish it, or any other considerations, and obtain prior approval from the employer and the specialist authority, and that it is all Contractors in the coalition are restricted in the record, and that their registration be valid.

The law stipulated that it be determined by a decision of the Director General of Dubai Municipality, in coordination with the specialized authority, conditions and procedures for registration and renewal of the members of the technical staff in the registry, issuing a certificate of competence to them, and the validity of the registration of the technical staff in the registry, and cases of the suspension of the technical staff member from practicing his work in a temporary manner, as well as cases of deletion from the record, The conditions and controls of re -registration in addition to determining the obligations of the technical staff.

With no violation of any more severe punishment stipulated in any other legislation, everyone who violates the provisions of this law and decisions issued by a financial fine of no less than (1000) thousand dirhams and not exceeding (000,100) hundred thousand dirhams, and the value of the fine in the event of the violation of the same within one year of the date of committing the previous violation of it, is doubled It does not exceed its maximum (000,200) hundred thousand dirhams, and one or more of the following measures may be taken against the violation:
• Stop the contractor from practicing contracting activity for a period not exceeding one year.
• Download the contractor classification category to a lower category.
• The contractor’s registration is removed from the record after obtaining the approval of the “Contracting Construction and Development Committee” on this, and to address the authorization of the license to cancel its commercial license, in accordance with the procedures approved in this regard.
• The temporary suspension of any of the technical staff members of the contracting activity.
• Canceling a professional competence certificate issued to any of the technical staff and removed his registration from the record.

Connecting the situation.
Law No. (7) of 2025 obligated all contractors working in the Emirate of Dubai at the time of the implementation of this law to reconcile their conditions in accordance with its provisions, within one year of the date of its implementation, and the committee may organize and develop the contracting of the contracting of this deadline for a similar period when necessary, and in the event that the contractor is registered in the record during the deadline specified to reconcile the conditions, the conditions end, His registration is renewed in the record, while obliging him to submit a declaration that pledges to reconcile his conditions during that deadline.

Any text in any other legislation is canceled to the extent to which the law contradicts, and the work of the regulations and decisions issued by the competent authority before the implementation of the new law, and organized to practice the contracting of the contracting, continues to the extent in which it does not contradict the provisions of this law, until the issuance of regulations and decisions that are replaced.
