The European Commission launches the first review of foreign support regulations

Brussels on August 12/ WAM/ The European Commission announced the start of the first foreign support regulations (FSR) that began to be applied on July 13, 2023, with the aim of assessing the effectiveness of the rules in addressing competitive distortions resulting from support provided by countries outside the European Union.
In a first step, the Commission seeks to collect the opinions of all the parties concerned through a general consultation and an invitation to provide evidence, until November 18, 2025, through the “Share your opinion” portal for the European Union, and in any official language of the Union.
The targeted bodies include companies, law offices, member states, professional associations, individuals and research community.
The review focuses on several main axes, including assessing the impact of foreign support for competition in the internal market, the application of the “budget test” between the positive and negative effects of support, the possibility of opening investigations on a self -commission initiative, reviewing the limits of notification, as well as measuring the complexity of the rules and the cost of adhering to companies.
According to the regulations, the Commission must review the application and implementation of these rules by July 2026, then every three years, and submit a report by the European Parliament and the Union Council that may include new legislative proposals.
The Commission emphasized that this review aims to ensure equal opportunities among all companies, while maintaining the opening of the European market to trade and investment.
