A young man demands a girl of 50 thousand dirhams to compensate for accusing him of committing a blatant act

The Abu Dhabi Family and Civil and Administrative Courts rejected a young man who demanded a girl to compensate of 50,000 dirhams, for accusing him of committing a blatant act, based on the issuance of a verdict of his innocence of the accusation.

The court indicated that the ruling of the prosecutor was not a result of the malfunction of the communication, but rather because of the insufficient evidence.

In his lawsuit, the young man stated that the defendant filed a complaint, and opened a criminal communication against him, accusing him that he committed a clear act, bound a criminal lawsuit against him, and the ruling was brought up to his innocence of what was assigned to him.

He pointed out that the defendant was unjustly accused, and offended the use of her right to litigate, and informed a lie, and that he was damaged by material and moral damage, represented in his exposure to imprisonment and hypnosis in a hospital, as is fixed from the case papers.

In turn, the defendant submitted a memorandum of siphon at the end of her rejection of the lawsuit for lack of jurisdiction, lack of health and evidence, and obliging the plaintiff to fees, expenses and law fees.

For its part, the court clarified in the reasons for its ruling, that it is scheduled that the right to resort to the judiciary to defend the right that the law protects from the legitimate public rights that prove to all, and that it does not entail accountability with compensation unless it is proven that the one who initiates this right is deviated from what was set for him and used it as a malicious use, in order to seek the harm of his opponent, without an interest he asks for it, and then the use of this right or the use of this right It does not result in the slightest responsibility towards the lawsuit.

The court indicated that the papers were empty, which proves that the defendant used its right to litigate, as well as what was reported to be a lie and maliciousness of the defendant’s communication and the criminal case against the plaintiff, or its arbitrariness and exaggeration in its use of the right Because of the insufficient evidence, and therefore the court extracts from the defendant’s position to use it for its right to litigate, and does not discover from its position in transgression of its right, especially since the plaintiff did not prove that the defendant’s intention is the plot, the intransigence, the affection for it and the custodian in the litigation.

The court sentenced the case to the case, and obliging the plaintiff to fees and expenses.
