He stressed that the decision to form the incubation committee in Dubai is one of the best and most important decisions issued in the interest of the child in the judicial side, pointing out that the judge in the past, by virtue of his circumstances and the nature of his profession, would not have running behind a party to see a criminal record or examine a field in the field, so the committee is now appointed by the judiciary, and 98% of its reports were approved in the cases that took its research.

In detail, the head of the family guidance department, head of the incubation committee in Dubai, Ahmed Abdel Karim, said that some parents use indoctrination as a weapon to request the dropping of custody or depriving the other party of vision in the family conflicts mutual between them.

He continued that the members of the committee sat with the children, and asked why you do not want your mother? He pointed out that the court referred the case to the incubation committee, and the shock was that the mother resorted to escalation, and committed a very dangerous behavior, as she took the children to a psychiatrist, and found them to say that their father harassed them.

Abdel Karim said that the committee team sat with her and asked her about the harassment incident, and she was confused, and she said, I saw nothing, but the daughter said that, then she changed her words, and she claimed that he was violent with the girl, then she mentioned that her daughter was fancy, and she was not responsible for that.

He added that the social researcher sat with their son as a young child, and I asked him after she reassured him and felt comfortable with her, whether he loved his father, and the child replied in the affirmative, then I asked him, do you want to see him, so the child hesitated, and said, “My mother can get angry.”

He pointed out that by examining the case, it was found that the man is a good father, loves his children, and is emotionally related to them, spent on them with generosity, and sponsors their expenses, and he goes to the school waiting in the sun to see them, and then after the committee obtained several clues, I submitted it to the court and recommended to drop the nursery and this is a great matter, and the court responded and a ruling was issued to drop, so the mother appealed to him, but the court supported him.

Abdul Karim stressed that the accusation of one of the two parties of harassing the children, whether it is by the mother towards the father, or by the latter towards the mother’s husband, is a great matter, danger, and the heart of the heart, because its effect is destroyed in the children, and it cannot be tolerated with him.

He continued that if the matter was in his hand, he would be tightened in the articles of the law related to the vision, because it is not entitled to deprive the other of the vision of his children, as this is a major reason for delinquency, pointing out that despite the legislative amendments in this regard, the problems are still continuing in all the emirates of the state.

He stated that one of the cases with which the committee dealt with is a father who noticed that his children repeat one words against him: “You are hitting us”, “We do not love you”, “We are afraid of you”, so he raised his complaint to the court.

He continued that the mother denied that she had found them, and said that the children express their feelings honestly, so the committee listened to the children, and noted that the answers are repeated and similar in an abnormal way, which indicated the presence of indoctrination.

This was recorded as a negative factor against the mother, and confirmed that it harms the interests of children, and the court adopted the report.

The head of the incubation committee, Ahmed Abdel Karim, said that the committee is Ain al -Qadi, and its roots are due to Article (59) of the Children’s Rights Law “Widima”, but its institutional launch came by a decision issued in mid -2022 by His Highness Sheikh Maktoum bin Mohammed bin Rashid Al Maktoum, First Deputy Governor of Dubai, Deputy Prime Minister and Minister of Finance, Chairman of the Judicial Council in Dubai, and since that date, the committee is considered as the social and criminal arm of the court The facts are investigated, field visits are being made, and a technical recommendation is made that appoints the judge to form his conviction in custody claims.

He added that the committee consists of seven members delegated from multiple parties, two members of the Dubai Police (one of them concerned with the rights of the child), a member of the Community Development Authority (for field tasks and observation of the child’s environment), a member of the Dubai Health Authority (for psychological and physical assessments when needed), and a member of Dubai courts, along with a social worker who is the report from within the court. He continued that when the members of the committee selected the standard of “the most suitable”, functional and experience, without personal requirements that are not required by the job (such as marriage, for example), pointing out that in the current formation there are three men and four women, which achieves a professional and conscience balance.

He continued that there is a very important field aspect in the work of the committee, as it moves to the child’s home, school and surrounding environment, and collects social, psychological, field and criminal clues, and it is formulated a complete professional recommendation.

He explained that the committee does not fulfill the law, and the texts are not revealed to the facts, because this is the matter of the court, but it prepares the technical ground, and determines whether the child’s environment is appropriate, and is there harm, and what is the degree of attachment, and whether there are disturbances or neglect, then the recommendation is raised, and the judge has the word separation in the application of the rules (such as the fall of custody with the mother’s marriage within the periods of legal notification, or the end of the nursery age), or other reasons.
