Stopping in the middle of the road: an “unjustified mistake” that leads to fatal accidents

Drivers caused fatal accidents due to abandoning their vehicles or standing in the middle of the road without justification, and the state courts and police commanders, including Dubai Police, recorded several accidents due to this behavior, which is sometimes motivated by simply proving a case in a simple accident, despite the possibility of moving the car to a safe parallel area, and among them was a serious accident that resulted in the death of a person and the person responsible claimed that his vehicle had suffered a malfunction and he was unable to move it, and it was The surprising thing from examining it was that it had no faults, and it was operated and moved after the fatal accident.

“Emirates Today” monitored accidents, including an accident caused by a person of Asian nationality who was driving his vehicle on Sheikh Zayed Road, and stopped in the middle of the road without taking the necessary measures to ensure the safety of movement on the street, then he abandoned the car and left with his brother, only for a vehicle coming from behind to collide with it, causing the death of its driver and the injury of another.

Upon examination of the accident by accident planning experts at the General Traffic Department of Dubai Police, it was found that responsibility falls primarily on the driver of that vehicle, due to negligence, lack of attention, and parking in the middle of the street without justification.

When the accused driver was questioned, he stated that he was driving his car in the fifth lane from the left on Sheikh Zayed Road in the direction leading to the Emirate of Sharjah, then its engine suddenly stopped, and he tried to start it twice, but to no avail, so he called the police and used the warning lights.

He added that after about five minutes, he got out of the vehicle with his brother, to place the warning triangle behind it, and another car collided with it from behind, and his brother was injured, while the driver of the other vehicle died.

The Traffic Committee’s technical report on examining the accident revealed that the vehicle was started, and it was found that there were no malfunctions in the engine, and that all systems were working efficiently, and it was transported and moved to the inspection site without problems.

The report explained that responsibility for the accident falls on both parties due to negligence and inattention on the part of the first driver who stopped his car in the middle of the road without justification and did not take the necessary measures to ensure its safety on the road, while the victim did not leave a sufficient distance between himself and the vehicles in front of him and was unable to avoid them.

The accident caused the driver of the oncoming car to be injured, and he was taken to the hospital by ambulance to receive treatment, but he died as a result of the injuries he sustained.

The court explained in the merits of its ruling that the negligence of the driver of the first vehicle is a form of error that entails criminal liability, as he violated the duties of caution imposed by the law, and also refrained from taking a course required by the rules of human experience, which is moving the car from the middle of the road, to avoid the consequences that resulted from it.

The Dubai Traffic Court concluded that, according to the inspections of accident experts, and what was proven in the report of the Technical Committee for Vehicle Inspection, the driver of the first vehicle did not take measures to ensure the safety of parking in the river of the road, and therefore he is directly responsible for the accident, and the victim was exposed to injuries that led to his death, in addition to the injury of another person.

It convicted the driver accused of accidentally causing the death of a person as a result of standing in the middle of the road without justification, or taking all necessary measures to ensure the safety of movement, in addition to the charge of accidentally harming the safety of a person’s body, and destroying property owned by others, and punished him with a fine of 10,000 dirhams, in addition to paying blood money of 50,000 dirhams to the heirs of the deceased in the accident, given that the latter bears part of the responsibility.

The accidents recorded by Dubai Police included a motorcycle colliding on Sheikh Mohammed bin Zayed Road from behind with a truck that suddenly stopped in the middle of the road due to a technical fault. The accident resulted in the bike driver being seriously injured, while Abu Dhabi Police recently broadcast a video of accidents that occurred as a result of unjustified parking in the middle of the road, calling on drivers not to stop for any reason, and to go directly to the nearest exit to ensure the safety of the vehicle’s passengers. And road users.

She stated that in the event of the inability to move the vehicle, it is necessary to immediately contact the Command and Control Center on the emergency number 999 to provide the necessary support to avoid serious and dangerous accidents and obstruction of traffic.

While Dubai Police warned of the danger of standing in the middle of the road as a result of a vehicle malfunction, running out of fuel, or a failure of the vehicle’s tires, pointing out that the driver must ensure the safety of the vehicle’s parts before leaving the house.

She explained that parking in the middle of the road is one of the most serious violations that result in serious accidents and result in deaths and serious injuries, noting the necessity of contacting the police if the vehicle breaks down and cannot be moved, so that the necessary measures can be taken, such as securing the broken down vehicles with police patrols, and taking the measures followed in these cases to protect passengers and road users.

Drivers who commit the violation of “standing in the middle of the road without justification” are punished with a fine of 1,000 dirhams and six traffic points, while those who commit the violation of “obstructing traffic” are fined 500 dirhams.
