Fine and suspension of driver’s license under the influence of alcohol

The Dubai Traffic Court ruled to punish an Asian man with a fine of 15,000 dirhams and suspend his driving license for three months, after it was proven that he had consumed alcoholic beverages and driven his vehicle under the influence, which led to him ramming a cement barrier and damaging his private vehicle.

In detail, a report was received from the Operations Room about an accident on Emirates Road heading towards Abu Dhabi before the Umm Suqeim Street exit, and it was found that the accused was driving his vehicle without adhering to his lane, which caused him to collide with the cement barrier and damage the vehicle.

During the inspection, the police patrol noticed the smell of alcohol emitting from the accused, so he was examined using an inhaler, which resulted in the presence of an alcohol level in his blood. He admitted during the Public Prosecution’s investigations that he had consumed alcoholic beverages and driven the vehicle under its influence, admitting to committing the incident.

The court indicated in the merits of its ruling that the incident was established beyond a reasonable doubt based on the arrest reports, alcohol test reports, a diagram of the accident site, and the accused’s statements during the investigations, considering that this evidence is sufficient to convict him.

She added that the charges against the accused are linked to a single criminal purpose and are indivisible, and according to the law, the charge was considered the most severe to determine the punishment, with the accused being granted a measure of clemency taking into account the circumstances of the case.

She pointed out that the defendant’s material and moral fault had been proven according to the law, and that the court relied on all the evidence presented, including his confession of what was attributed to him.

She pointed out that the penalty is implemented immediately upon its issuance, with the accused being obligated to pay the fine due and suspending his driving license for three months, provided that he is released if he is not convicted, arrested, or wanted for any other reason.
