المملكة: New amendment.. Learn about the cases of death eligible for military retirement

Clarified new modification in Military Retirement System The phrase “those who die during and because of work” refers exclusively to cases in which a soldier dies while performing his normal work and due to a direct reason related to it.

He stressed that this category does not include the cases stipulated in Paragraph “B” of the same article, which relates to the citation in War conditions, in a move aimed at strengthening Legislative clarity and ensuring the rights of military personnel and their families.

The decision came to set a precise definition of deaths that entail retirement benefits, whether they occurred during the performance of duty or in exceptional circumstances related to war.

As for Paragraph “B” related to the phrase “If a soldier is martyred due to a service he was ordered to perform during the outbreak of war,” the decision set three main conditions for its application, as follows: “A direct causal connection: that the soldier’s death resulted from an official mission assigned by his command.” “A connection to the war: that the mission be directly related to war operations or tasks” and “timing of death: that the death occurred during the period of the war itself.”

The decision stressed that the application of this paragraph is not linked to a specific geographical scope, which means That martyrdom may occur inside or outside the area of operations as long as it is linked to a combat mission in wartime.

The decision came after extensive reviews that included the treatment received from the Royal Court, review of the military retirement system, and the memos of the expert panel, in addition to the minutes of the Council of Economic and Development Affairs and the recommendations of the General Committee of the Council of Ministers, which reflects the importance of the issue from a legal and regulatory perspective.
