"Real Estate Authority" The period for notice of non-renewal of residential lease is increased to one year

The decision stipulated that the period of the landlord’s notice to the tenant in typical contracts for renting residential real estate be increased to a period of no less than 365 days, i.e. a full Gregorian year, before the end of the existing contract, stressing that this amendment is considered an exception to the previously applicable periods.

The authority explained that the application of this exception is limited to specific cases, including the landlord’s desire not to Renewing the contract for the purpose of using the property for personal use, or vacating it for use by one of his first-degree relatives, in a way that achieves a balance between the rights of the lessor and the requirements for the stability of the tenant.

The General Real Estate Authority confirmed that the decision comes within its efforts to regulate the contractual relationship between landlords and tenants, protect the rights of both parties, and reduce rental disputes, in accordance with the provisions of the residential real estate rental system issued pursuant to Royal Decree No. “M/73.”

The Authority indicated that the decision will be implemented. It begins from the date of its issuance, provided that it is published in the Official Gazette and notified to the relevant authorities for implementation, as part of their continuing efforts to develop the real estate system, raise the level of transparency, and enhance stability in the residential rental market in the Kingdom.
