The Abu Dhabi Family, Civil and Administrative Claims Court ruled that a man was required to pay his lawyer an amount of 10,500 dirhams, the value of the third installment of the fees agreed upon between them, in exchange for filing a compensation claim for him, according to which he obtained 250,000 dirhams, in addition to 200,000 the value of the legal blood money.
In the details, a lawyer filed a lawsuit against a former client, in which she requested that he be obligated to pay her 42 thousand dirhams and the late interest of 5%, while obliging him to pay fees and expenses and in exchange for attorney’s fees, noting that the defendant requested to obtain her advisory and legal services, and to represent all heirs to file a lawsuit against her. A lawsuit was filed against a company to claim compensation for the death of his son, and a fees contract was drawn up between them. Care and effort were exerted in the claim, including submitting newspapers, lawsuits, and requests. It was followed up until the value of the blood money, which was 200 thousand dirhams, was received.
The plaintiff indicated that, after the plaintiff obtained the blood money, she continued to perform her duties to the fullest extent, until a ruling was issued in favor of the defendant, awarding him and the heirs compensation amounting to 250 thousand dirhams, with 5% interest, but the defendant failed to pay the fees in accordance with the agreement. concluded between them. Although the defendant received the amount, he paid 21 thousand dirhams, and had an amount of 42 thousand dirhams in reserve, and when he was asked to pay, he began to procrastinate.
For its part, the court stated in the merits of its ruling that what is established from the lawsuit documents is the existence of an agreement between the two parties, stipulating that the fees of the first party (the plaintiff) for the compensation claim will be 63 thousand dirhams, including the value of the added tax, provided that payment is made in three installments (each A payment of 10 thousand and 500 dirhams, the first upon signing the agreement, the second one month after it, and the third one month after that), in addition to the deferred fees of 31 thousand and 500 dirhams when Collecting the compensation value.
The court indicated that the plaintiff is demanding the rest of the fees (42 thousand dirhams), which shows that the defendant paid 21 thousand dirhams for the first and second installments, and the third installment has come due and he has not paid it.
The court confirmed the defendant’s announcement, but he did not appear, and did not provide a release of his liability for the amount claimed, which required the plaintiff to pay the value of the third installment only, because she did not provide evidence that she was entitled to deferred fees in the amount of 31 thousand and 500 dirhams, which is restricted by the condition of maturity when the value is collected. Compensation.
She explained that the plaintiff’s statements “came sent, and the defendant’s receipt of the blood money does not mean that he received the value of the compensation, because the blood money differs from the compensation stated in the fees contract concluded between the two parties.”
It was ruled obligating the defendant to pay the plaintiff 10,500 dirhams, the value of the third installment of the attorney’s fees agreed upon under the contract, while obliging him to pay a 5% delay interest from the date of filing the lawsuit until full payment, not to exceed the principal of the debt, while obliging the defendant to pay fees and expenses and reject what Other than that, requests.
