Obliging a guardian to pay 119.3 thousand dirhams in school arrears

The Abu Dhabi Family, Civil and Administrative Claims Court ruled to oblige a guardian to pay 119,333 dirhams in academic arrears to a private school. The court also obligated the defendant to compensate the school for the material damages resulting from failure to pay in the amount of 2,000 dirhams.
In detail, a private school filed a lawsuit against a guardian, demanding that he be obligated to pay it an amount of 119 thousand and 333 dirhams and the legal interest at 12% annually until full payment, and obliging him to pay her 5,000 as compensation for the damages she suffered as a result of not paying the amount due, and obligating him to pay the fees. And expenses and attorney’s fees, noting that the defendant has children who were previously registered in school and the amount of the claim is allocated to him as educational dues, and he has Refuse to pay it.
For its part, the court explained that what is evident from the case papers, copies of the student registration contracts (the defendant’s children), and the statement of account submitted by the plaintiff, is that there are sums owed by the defendant amounting to 119 thousand and 333 dirhams, and he did not pay them, and the defendant did not attend the session despite Declaring it legally to pay the lawsuit and prove that what the plaintiff claims is incorrect, and that it is the opposite of what she stated in the lawsuit, and then it considers that his debt is occupied by that amount for the benefit of the plaintiff, and the court rejected the request. The plaintiff claimed interest, and justified that she saw no reason for that.
Regarding the plaintiff’s request for compensation, the court indicated that, according to the provisions of the Civil Transactions Law, “every harm to others obligates the perpetrator, even if he is not discerning, to guarantee the harm.” The defendant’s mistake was proven according to what the court concluded in its previous ruling, and that mistake caused the plaintiff material damage representing In depriving her of benefiting from the amount in question, the court ruled to oblige the defendant to pay the plaintiff the amount of 119 thousand and 333 dirhams, and also obligated him to pay the amount of 2000 Dirhams in compensation to the plaintiff, in addition to the fees and expenses of the lawsuit, and the rejection of any other requests.
