Trump resorted to a war law to expel “illegal” migrants

A federal judge in Texas saw that US President Donald Trump resorted to an exceptional law to expel “illegal” immigrants, and later prevented every expulsion in his judicial mandate on this basis.

Several courts and federal courts, as well as the Supreme Court, have temporarily suspended resorting to the law of 1798 related to “foreign enemies”, which was so far used exclusively in wartime, on the pretext that the expelled persons should be able to claim their right.

However, Judge Fernando Rodriguez in the South Texas region is the first to include the essence of the case, that is, the legitimacy of resorting to this law.

Trump resorted to this law in a presidential declaration published on March 15th against the Venezuelan gang, “Trine de Aragoa”, which Washington ranked “terrorist” on the same day that about 250 people were expelled to El Salvador, most of whom were accused of belonging to this gang, where more than half of them were expelled under Law 1798.

The US government is later prohibited from the arrest of Venezuelan citizens, their transportation within the United States exclusively on the basis of this law.

The judge’s decision in his jurisdiction, that is, southern Texas, which includes the cities of Houston and Brazensville at the border with Mexico.

The lawyer for the Organization for the Defense of Civil Rights (ACLU), who defends the rights of the plaintiffs in this case, welcomed the decision, considering it “a very important decision.”

“Congress has never wanted to use this law that returns to wartime in the 18th century in this way.”.

Trump and his al -Salvaduri counterpart, Naguib Boukila, agreed last month to combat organized crime, with the latter asserting that he would not return to the United States immigrant to his country’s nationals who were mistakenly deported.

Upon his reception, Trump condemned the Boukilah at the Oval Office of the presence of “millions” of immigrants, including criminals, who illegally arrived at the United States, praising the assistance provided by El Salvador to address the matter.

“They have committed a sin and provided us with help,” Trump said, referring to the “open border” policy that the former US administration headed by Joe Biden was headed.

Boukila agreed to allow more than 250 deported people from the United States to be imprisoned in El Salvador from the United States, to be placed in a detention center “to contain terrorism”, a prison that he built as part of his war on gangs.
