It is not permissible to claim compensation that exceeds the limits of the amount in the insurance policy

The Dubai Court of Cassation approved a new principle, based on an appeal by the Attorney General of the Emirate of Dubai, which states that “it is not permissible for the insured, the driver of the vehicle that caused the accident, or the people who work for the insured – if they are injured during or because of work – to demand compensation from the insurance company insuring that vehicle that exceeds the limits of the amount specified in the additional appendix to the insurance policy on the pretext that the physical injuries sustained by any of them exceed that value.”
The Dubai Prosecution said in a blog post on its official account on the “X” platform: “The Dubai Court of Cassation approves a new principle based on the appeal of the Attorney General of the Emirate of Dubai, which states that it is not permissible for the insured, the driver of the vehicle that caused the accident, or the people who work for the insured – if they were injured during or because of work – to demand compensation from the insurance company insuring that vehicle that exceeds the limits of the amount specified in the additional annex to the insurance policy on the pretext that the physical injuries sustained by any of them exceed that value, since the aforementioned persons are Originally from the excluded categories who are not covered by insurance for civil liability arising from accidents that occur from the insured vehicle, unless they obtain additional coverage under an addendum or another document.”
