Will the South Korean President appear for questioning tomorrow? His lawyer answers

South Korean President Yoon Suk-yeol’s lawyer said on Tuesday that the latter is unlikely to comply with the request to appear for questioning this week by the martial law investigation team, according to what was reported by the South Korean “Yonhap” news agency.
The joint investigation team seeks to interrogate Yoon personally regarding his alleged involvement in the failed attempt to impose martial law on December 3, against the backdrop of accusations of rebellion and abuse of power, and he was asked to appear for questioning tomorrow, Wednesday.

Impeachment trial procedures

Suk Dong-hyun, Yoon’s lawyer, said his client is prioritizing the Constitutional Court’s impeachment proceedings, and he plans to issue a statement on his position on the trial after Christmas Day.
“We see it as unlikely that he will be able to come tomorrow,” Sock told reporters.
He added: “The president believes that the impeachment trial procedures conducted by the Constitutional Court should have priority, after the National Assembly began the impeachment process.”

The Bureau of Investigation of High-Official Corruption sent two summons to Yoon, requesting that he appear for questioning as part of investigations into Yoon’s short martial law order, but Yoon did not comply with the first summons last Wednesday.

Martial law in Korea

The legal defense team for ousted South Korean President Yoon Suk-yeol said on Tuesday that Yoon’s imposition of martial law, which lasted only hours, does not rise to the level of being accused of rebellion.
It is noteworthy that a trial is currently being prepared before the Constitutional Court to determine whether Yoon will be removed from office or his presidential powers will be restored, after Parliament voted last Saturday in favor of his removal due to his imposition of martial law, which did not last long.

“President Yoon will express his position in court with confidence and in accordance with his own convictions,” Sook said.
He added: “The president does not consider sedition charges as a legal concept, but realistically, since the investigative agencies are behaving this way, there will be a response to the investigation.”
The lawyer stated that the legal defense team plans to divide its work into 3 areas, which are dealing with investigations, the impeachment trial, and other trials.
