Control Violation

The decision clarified that arresting a violation does not require the presence of the violator at its location, and it is not necessary to arrest all violators at the same time, provided that the arrest data includes the basic information of the violator, the type of violation, the classification of its seriousness, and the penalty prescribed for it, in addition to the date, time and location of monitoring the violation.

Special reports are prepared in the event that the violator cooperates, resists, or obstructs the control work, enabling the center to complete the procedures in coordination with the competent authorities, in addition to Providing monitoring through live filming using designated cameras, in a manner that does not conflict with the relevant regulations and instructions.

The table specifies violations Traffic safety, which includes the absence of lighting reflectors on the barriers of turns and traffic diversions at the work site, and a fine of up to 3,000 riyals per day.

If reflective guidance and warning signs are not placed, the fine reaches 4,000 riyals. As for failure to maintain these signs, the fine reaches 3,000 riyals, as well as failure to provide a buffer safety area at the beginning of the site.

A fine of 5,000 riyals is imposed in the event of failure to provide Alternative routes using reflective signs, or tampering with road signs regulating traffic, or not putting up warning lights, as well as starting work without preparing a traffic management plan or not following it.

The regulation imposed a fine of up to 5 thousand riyals for other violations within this framework, which included failure to maintain the upper insulating panels for the type of work “hoarding” above the concrete barriers, and failure to adhere to the specifications of the identification logos on all temporary barriers, in addition to not using the approved model for the project information panel or the panel not containing all the data required according to the model. With regard to warning and visual warning means, the fine was estimated at 2,500 riyals in the event of not installing or straightening the “LED” warning sign throughout the entire work area, or using “LED” warning lighting in a color other than the approved white color.

Fining violators

As for violations of business execution practices, the table stipulated that a fine of up to 5,000 riyals be imposed upon committing a number of violations, including excessive lighting. A fine of up to 3,000 riyals was set for other violations within the implementation work, including not withdrawing water resulting from excavation according to the soil examination report, and not maintaining general cleanliness during implementation, while a fine amounting to 2,500 riyals was imposed in the event of damaged signs or warnings on the fence or fence surrounding the work site.

With regard to work waste, the regulations stressed the imposition of a fine of up to 10 thousand riyals when placing implementation waste in the vicinity of the work site during Implementing infrastructure projects.

Within the framework of worker safety, the penalties stipulate the imposition of a fine of up to 3,000 riyals in the event that workers do not adhere to personal safety or reflective means or do not adhere to the uniform inside the work site, while the fine reaches 5,000 riyals in the event of not maintaining temporary barriers at the work site. A fine of one thousand riyals was also set when fire extinguishers were not available in the equipment and machinery used on the site.

As for violations of licenses, qualification and accreditation, the fine was estimated at 5 thousand riyals in the event of working on the site without a license, or carrying out work in a manner contrary to what was stipulated in the issued license. The fine rises to 10,000 riyals when there is no permanent work outlet to complete the existing work or it is closed after the implementation by the outlet specified in the license is not possible.

The penalties also included imposing a fine of up to 20,000 riyals when using a drilling license in a manner that violates the content of the license, while the fine reaches 30,000 riyals if an emergency drilling license is used for non-emergency work. The regulations also stipulate a fine of 15,000 riyals when continuing to work on the site. Without renewing the license to operate infrastructure projects.
