A man wearing a “shorts” and sits in front of the TV takes a mother’s nursery

The head of the incubation committee, head of the Family Guidance Department of the Personal Status Court in Dubai, Ahmed Abdul Karim, revealed that the committee issued recommendations to drop the nursery about mothers in several cases, including making sure that a strange person hesitated to the home of one of the incubators at inappropriate times, sitting in front of the TV to watch the matches wearing a shorts, and repeated the exit of another mother at night and left the child with the maid, as well as abuse of the daughter before a friend A mother.

Abdel Karim said, in an interview with the “Arab Cast” platform, that the child’s attachment to the mother is not enough to continue her incubator if the child’s presence with her represents a clear harm to him, such as the case of a teenage girl whose mother allowed her to stay up outside until late.

In detail, the head of the incubation committee stated that the committee takes over an important field aspect in the disputes related to the nursery, so it moves to the child’s home, school and surrounding environment, and the assembly of social, psychological, field and criminal clues, and then the preparation of the technical ground for the court, and determines whether the child’s environment is appropriate, and is there harm, and what is the degree of attachment, and is there disturbances or neglect, then the recommendation is raised, Whether by ruling to drop the nursery, or its continuation or other provisions related to the subject of the dispute.

He added that there are cases in which the committee recommended to drop the nursery from the mother, among them a father who complained that his 14 -year -old daughter is free to stay free outside the house and return near the middle of the night, indicating that the mother is easily easily and does not impose appropriate oversight, while the mother replied that the girl is a teenager, and that she trusts her, and considers that granting freedom is better than imposing restrictions that make her rebellion.

He pointed out that the committee listened to the two parties, reviewed the statements of the girl herself, and discovered that she was constantly going out at late times without direct supervision, and then recommended that the custody move to the father, because it is more keen on discipline and protecting the girl in a sensitive stage, and the court agreed to the recommendation of the committee, and considered that the “attachment to the mother” is not sufficient if it has clear harm.

In another case, a father said that the mother graduated at night frequently and left the children with the maid, and strengthened his statements with reports from the school about the weak performance of the children in a study, and the mother replied that her exit was necessary for family reasons, and there was no direct harm.

The committee was achieved from the field records, and it was proven that the absence was actually repeated, and that the children remained for long periods with the maid, and recommended that the custody transfer to the father, although the mother had been criminalized in another case, and the court agreed to the committee’s recommendation.

Among the remarkable issues is that the father submitted a communication in which he said that a strange man resides at a near -daily pace in the mother’s house in the presence of their son, after the latter told him that, and the mother replied that the man was her neighbor, and that he visited her once to fix the TV

He revealed that the committee listened to the child (eight years), and he told innocence that “Amo” “sitting in the hall, watching the matches, smoking while he was shorts.”

The fine details mentioned by the child made the committee tend to believe him, and the problem was not in the mother’s behavior as much as the contradiction of her conversation, and her tolerance of a stranger to stay at home permanently threatens the educational environment, and the committee recommended to drop the nursery, and the court agreed to this.

In another case, a father filed a lawsuit in which he said that the mother of the mother treats his daughter, the child (nine years), as a bad treatment, while the mother denied this, and insisted that the father exaggerates to distort her image.

Abdel Karim said that the committee listened to the girl, and I mentioned accurate details of inappropriate positions, and by examining the case in the field, it confirmed that there was harmony between its statements and what the researchers noted socially, so the committee recommended that the girl be removed from this environment, and the mother’s custody was dropped, and the court supported that.

The head of the incubation committee, Ahmed Abdel Karim, stated that the committee is considered Ain al -Qadi, and its roots date back to Article (59) of the Children’s Rights Law, “Wadima”, but its institutional launch came by a decision issued in mid -2022, His Highness Sheikh Maktoum bin Mohammed bin Rashid Al Maktoum, First Deputy Governor of Dubai and Deputy Prime Minister and Minister of Finance and Chairman of the Dubai Judicial Council, and since that date, the social -psychological -criminal arm is prepared for the court The facts, field visits are taking place, and submit technical recommendations that appoint the judge to form his conviction in custody claims.

The committee consists of seven members delegated from multiple parties, namely: two Dubai Police (one of them is concerned with the rights of children), a member of the Community Development Authority (for field tasks and observation of the child’s environment), a member of the Dubai Health Authority (for psychological and physical evaluation when needed), and a member of Dubai courts, along with a social worker who prepares the report from within the court.

He continued that when the members of the committee chose the standard of “the most suitable” of “the most suitable” standard and experience, without personal requirements that are not required by the job (such as marriage), pointing out that in the current formation there are three men and four women, which achieves a professional and conscience balance.
