The Abu Dhabi Family, Civil and Administrative Claims Court ruled to reject a lawsuit filed by a young man against a girl, asking her to return 100,000 dirhams that he had transferred to her in her bank account. The court indicated that financial transfers are merely a transfer of money from one person to another, and whoever claims the reason for this must prove it. In the details, a young man filed a lawsuit against a girl, in which he demanded that she be obligated to pay him an amount of 100 thousand dirhams, indicating that he transferred the claim amount to the defendant on her bank account, as a loan and debt, and she did not return the amount, and she procrastinated in doing so, while the defendant did not attend, and it was clear that her announcement was complete.

For its part, the court explained in the merits of its ruling that, according to the provisions of the Civil Transactions Law, the evidence to prove the right is (writing, testimony, evidence, inspection, experience, and acknowledgment, in addition to the oath), noting that the plaintiff filed his lawsuit to demand that the defendant be obligated to pay the amounts he transferred to her, and it was established and established by the court that financial transfers are nothing more than a mere transfer of money from one person to another, and whoever claims the reason for that must be responsible. Proof of it, as the principle is an exoneration of responsibility, and that her preoccupation is an incidental matter for which proof must be established.

The court pointed out that the plaintiff’s claim was sent without providing evidence of the validity of the debt, the agreement, and the reason for the transfers. The court was not obligated to assign the opponent to provide evidence of his defense, or to draw his attention to the requirements of this defense. It was sufficient for it to evaluate its ruling according to the documents presented to it. The plaintiff was the one responsible for proving his claim. The court ruled to reject the lawsuit as it stands, and to oblige the plaintiff to pay the fees and expenses of the lawsuit.
