Sultan Al Qasimi issues a decree establishing and organizing the Sharjah Cycling Club

His Highness Sheikh Dr. Sultan bin Muhammad Al Qasimi, Member of the Supreme Council and Ruler of Sharjah, issued an Emiri Decree regarding the establishment and organization of the Sharjah Cycling Club.

The decree stipulates that a club specialized in cycling shall be established in the emirate, called “Sharjah Cycling Club”, which shall have legal personality and legal capacity to carry out the necessary actions to achieve its goals and exercise its powers, affiliated with the Sharjah Sports Council and working under its supervision.

According to the decree, the name of the club will be adopted in the English language as follows: “Sharjah Cycling Club”, and the club’s headquarters and main center will be in the city of Sharjah. It is permissible, by a decision of the Sports Council, based on the president’s request, to establish branches in the rest of the cities and regions of the emirate.

According to the decree, the club aims to achieve the following: enhancing the emirate’s position and competitiveness in the field of cycling inside and outside the emirate.

Serving the sports, cultural and community sector in all aspects and developing cycling, contributing to the establishment and development of a modern and integrated legal and administrative system for the practice of cycling, ensuring the application of the highest standards of security and safety in tracks and paths in accordance with best practices, and encouraging the practice of cycling as a healthy and community sport that contributes to enhancing the lifestyle.

The decree stipulated that, in order to achieve its goals, the club would exercise the following powers: drawing up general policy and developing strategic plans to organize cycling in the emirate, qualifying a generation of sports leaders and competencies in the field of cycling,

Supervising and organizing bicycle tracks and paths and organizing events in the emirate in coordination with the relevant authorities in accordance with best practices.

Representing the emirate at the internal and external levels in everything related to cycling in coordination with the Sports Council, preparing and implementing introductory and promotional campaigns aimed at spreading the culture of cycling, organizing and hosting festivals, competitions, conferences and gatherings related to cycling and participating in them in coordination with the Sports Council, providing a supportive environment for various segments of society to practice cycling activities, and discovering and refining distinguished talents through the preparation of technical and physical programs and establishing sports teams capable of participating in local, regional and international championships. And achieving distinctive results, providing all the necessary capabilities and requirements to enable and encourage all segments of society to practice cycling and sporting, cultural and community activities, cooperating with various federations, clubs and institutions inside and outside the country, preparing and submitting recommendations and draft legislation related to the practice of cycling in the emirate to the Sports Council to take what it deems appropriate regarding it, applying quality systems, institutional work requirements and standards of excellence in the club, establishing commercial companies in all their forms, whether for sporting purposes or for investments belonging to the club after the approval of the Sports Council, and any other specializations assigned to the club by Governor or Executive Council.

According to the decree, the club is managed by a board of directors consisting of a president, a vice president, and a number of members named by a decision from the governor or his representative. The vice president is chosen from among the members during the first meeting of the council by consensus or through direct secret ballot.

The term of membership in the Council shall be four years, starting from the date of the decision to form it, and it may be extended for a similar period or periods, provided that the Council continues to carry out its work at the end of its term until a new Council is formed or the expired Council is renewed.

The decree stipulated that the following requirements must be met for a member of the council: that he be a citizen of the state, that he be civilly qualified, of good conduct, of good reputation, that he has not previously been convicted of a crime against honor unless he has been rehabilitated in accordance with the law, that he must not be less than twenty-one years of age, that he must not be a member of any of the boards of directors of other clubs, that his educational qualification must not be less than a high school diploma or its equivalent.

According to the decree, council membership is lost or dropped in the following cases: death, loss of one of the conditions for membership stipulated in this decree, written resignation and its acceptance by the Sports Council, absence from four consecutive council meetings or six separate meetings without an excuse accepted by the council during the calendar year, to be counted from the date of the first council meeting.

If the position of Council member becomes vacant for any of the reasons stated in the decree, the Governor or his representative may appoint a replacement, and the new member shall complete the term of office of his predecessor.

The decree also stipulates that, taking into account relevant federal and local legislation, rules and regulations, the club’s board of directors is responsible for directing the club’s work, managing its affairs, and working to achieve its goals. It is considered the supreme authority in it, and for this purpose it has the right to exercise the following powers:

Approving the general policy and strategy of the club, its programs and projects after presenting it to the Sports Council, supervising its implementation and developing plans that ensure the development of work in the club and its employees, supervising the progress of work in the club in accordance with applicable legislation and regulations, issuing the necessary administrative decisions and circulars and following up on their implementation, developing financial and administrative regulations and internal work systems for the club and the terms of membership in it and presenting them to the Sports Council, forming permanent or temporary committees to assist it in performing its duties, determining their names, tasks, powers, work system and supervising them, proposing the budget. Annual and approving the club’s final account and presenting them to the Sports Council to take the necessary action regarding it, representing the club in concluding contracts, agreements, memorandums of understanding and partnerships with others after their approval by the Sports Council, opening and managing the club’s financial and commercial bank accounts, appointing the executive director and technical and administrative staff.

Seeking the assistance of whomever he deems appropriate, including technicians, experts, volunteers, and competent authorities, to assist him in performing his duties and achieving his goals, and any other duties assigned to him by the Ruler or the Executive Council.

The club will have a full-time executive director with competence and experience in the sports and cultural field. He will be appointed by a decision of the club’s board of directors after the approval of the Sports Council. The council will determine his powers and duties and he will be accountable to it.

The decree also included legal provisions related to the meetings and responsibility of board members, financial resources, the fiscal year, organizational structure, decisions and regulations, and final provisions.
