Supported The Labor Court of Appeal issued a preliminary ruling that recognizes the worker’s right to leave work immediately and without any obligations or penalties, in the event that the establishment is late in disbursing his financial dues, considering that the wage is an essential pillar of the contractual relationship, based on Article “81” of the Labor Law, which guarantees the worker the right to terminate the contract upon breach of essential obligations.

The labor court prevailed for the employee’s right to financial security, upholding his right to leave work. Without the need to provide prior notice when it is proven that the employer has been negligent in paying wages.

The judicial ruling was based directly on the first paragraph of Article 81 of the Labor Law, which grants the worker the authority to leave work while retaining all his rights when the facility breaches its obligations.

Termination of the contractual relationship

The court considered during the hearing of the case that the facility’s acknowledgment of the delay in disbursing part of the wage represents conclusive evidence of negligence, which legally justifies the worker’s decision to terminate the relationship. The court established an important principle that adherence to the wage deadline is a “fundamental obligation” that may not be exceeded, and that any unjustified delay creates immediate legal consequences for the benefit of the affected worker.

The Court of Appeal rejected the employer’s attempts to overturn the ruling, and decided to accept the objection in form and reject it in substance, confirming the integrity of the initial ruling and its complete compatibility with the applicable statutory rules.

The judicial department concluded that the essence of the dispute was It lies in the “reason for leaving work,” and the court has proven with evidence that the reason is legitimate and consistent with the provisions of the system, thus closing the case file with a clear victory for labor rights.

This ruling comes to be a deterrent to procrastinating establishments, and confirms that the labor relationship is based on mutual obligations, and that failure to pay wages releases the worker from the restrictions of the contract.
