A young man threatens a girl with defamation on Instagram

The Abu Dhabi Family, Civil and Administrative Claims Court ruled that a young man must pay a girl 20,000 dirhams in compensation for the moral damages she suffered as a result of his threat to her via WhatsApp messages by preventing her from entering the country, defaming her reputation, publishing her photos on Instagram, contacting her family and claiming the existence of a relationship between them.
The Criminal Court convicted the defendant and fined him 5,000 dirhams, bringing the total amount of the penalty to 25,000 dirhams.
In detail, a girl filed a lawsuit against a young man in which she demanded that he be obliged to pay 50 thousand dirhams in compensation for material and moral damage, noting that she was harmed by the defendant with repeated phone harassment, threats to defame her reputation, attributing facts that affect her reputation and social standing, and sending messages that included threatening and abusive expressions, including claiming that he was able to prevent her from entering the country, and if she entered it, he would prevent her from traveling, and claiming to have a relationship with her, and talking about matters that affect her honor. And her reputation, and spreading false stories about her to others, in addition to sending her pictures through Instagram accounts, and communicating with her brother and father, using an international number.
His criminal conviction for these acts was confirmed and he was fined 5,000 dirhams, while the defendant submitted a reply memorandum in which he demanded that the case be dismissed.
For its part, the court stated in the merits of its ruling that what is established from the case documents is that the plaintiff had previously filed a complaint before the competent authorities against the defendant in which he was referred for criminal trial, and a final and final conviction judgment was issued against him, which enables the court to conclude with certainty that error on the part of the defendant has been proven in a way that establishes his responsibility for the act committed by him and accordingly establishes his obligation to compensate for the damage resulting from it with appropriate compensation.
Regarding the request for compensation, the court indicated that the defendant’s mistake had been proven with certainty by a final criminal ruling, which fulfills the elements of tort liability represented by error, damage, and causality, as what he committed of explicitly threatening the victim and repeatedly disturbing her through modern means of communication, promoting false facts that affect her honor and social prestige, communicating with members of her family, sending her pictures, and defaming her to others, all of which would by its nature cause her serious moral damage, which is: Harming her reputation and dignity, causing her pain, causing fear and anxiety, and destabilizing her sense of security and social stability.
The court concluded, from the circumstances and conditions of the case, the gravity of the acts committed, and their confirmation by a final criminal ruling, that “what happened to the plaintiff constitutes serious harm that requires compensation with compensation that achieves rehabilitation.” The plaintiff’s request for compensation for material damages was rejected, and she attributed her refusal to the lack of documents proving that she was financially harmed. It ruled to oblige the defendant to pay the plaintiff 20,000 dirhams, fees and expenses.
