Doctors’ branches discuss medical responsibility… and the General Syndicate provides free transportation for the January 3 emergency

The Assiut Doctors Syndicate held a meeting to discuss the draft medical liability law, in the presence of members of the Assiut Doctors Syndicate Council, and the Head of the Assiut Dentists Syndicate, Dr. Taher Sharif, and members of the House of Representatives, Prof. Dr. Hossam Helmy Madi, Major General Alaa Soliman, and Dean of the Faculty of Law, Assiut University, Dr. Dwaib Hussein, and the former head of the Minya Doctors Syndicate, Dr. Amr Ali, a group of Assiut doctors, fellow health service providers, and party members interested in public affairs.
The participants in the meeting affirmed their support for the position of the General Syndicate of Doctors, which completely rejects what is included in the draft law. Among the articles that legalize imprisonment in professional cases.
These meetings and conferences come within the framework of introducing the union’s demands and proposals regarding the draft law, and the seriousness of its issuance. In its current form, it affects the entire health system, as doctors’ work under the threat of imprisonment will push many of them to resort to defensive medicine.
The Medical Syndicate’s proposals include the following:
First: Refusing to imprison doctors. In professional cases, it is recognized that civil liability falls on the doctor if he causes harm to the patient as a result of an error, but he works in his specialty and is committed to the rules of the profession and the laws of the state. The penalty here is compensation to compensate for the damage and not Imprisonment.
Second: Criminal liability falls on the doctor only if he violates the laws of the state, works outside his specialty, or performs a medical procedure prohibited by law.
Third: Pretrial detention is not permissible in connection with accusations. Which arises against the health service provider during or because of the performance of his profession; Whereas justifications for pretrial detention are not available in professional cases.
Fourth: The necessity for the Supreme Committee for Medical Liability to be the technical expert for the investigation and litigation authorities, and to receive all complaints submitted against medical service providers with all relevant authorities related to receiving Citizens’ complaints about medical errors.
The Fayoum Doctors Syndicate also held an expanded meeting to discuss the draft medical liability law, in the presence of the Head of the Doctors Syndicate, Dr. Osama Abdel Hay, and the head of the Fayoum Doctors Syndicate, Dr. Muhammad Othman, members of the Syndicate Council, and Assistant Secretary-General of the Medical Syndicate, Dr. Khaled Amin Zare’, and Vice President of Fayoum University, Head of the Scientific Syndicate, Dr. Arfa Sabry, and the head of the Fayoum Pharmacists Syndicate, Dr. Rabei Al-Sudani, and the head of the Fayoum Dental Syndicate, Dr. Alaa Al-Ashery, and the head of the Fayoum Physical Therapy Syndicate, Dr. Ahmed Al-Sayed Farag, in addition to the presence of a representative of the Nursing Syndicate, and a large number of Fayoum doctors.
The participants in the meeting discussed the draft medical liability law, and the members of the Syndicate listened to the suggestions of the participants in the meeting, and the participating unions declared their solidarity with the demands of the Medical Syndicate.
The Fayoum Doctors Syndicate stressed its full commitment to the decisions of the General Syndicate Council and the call to participate in the emergency general assembly called for by the General Syndicate, regarding the draft law, and stressing the necessity of amending the draft law in a way that helps in producing a just law that protects The doctor protects the patient’s rights.
The head of the Doctors Syndicate called on Dr. Osama Abdel-Hay called on all doctors in Egypt to participate in the emergency general assembly next January 3, stressing that the strength of the union is the strength of its general assembly.
The treasurer of the General Syndicate of Physicians, Dr., said. Abu Bakr Al-Qadi said that the union council decided that the general union would bear the transportation of fellow doctors from the sub-unions to Dar Al-Hekma headquarters to attend the emergency general assembly on January 3, 2025.
