المملكة: Closing and a fine of one million riyals .. Amendments to the hospitality facilities schedule

The Ministry of Tourism presented a project to amend the schedule of violations of the activity of “private tourism hospitality facilities” via a “reconnaissance” platform, in a move aimed at updating and developing these tables to keep pace with organizational developments and modern standards.
The project aims to upgrade the quality of tourism services provided and enhance compliance with regulations, in addition to achieving a balance between control and development in the tourist hospitality sector.
The ministry has identified the concept of “grave violation” as every practice to operate tourism activities without a license or permit, or to continue operation after the end of the permit, its cancellation or suspension.
It also falls within this classification, any practice that may harm public safety or tourism, in addition to preventing the Ministry’s inspectors from performing their duties or refraining from cooperating with them.
With regard to the powers of the rhythm of penalties, tourism inspectors have been granted the authority to impose instant fines in violations that do not exceed 10 thousand riyals.
As for the rest of the penalties, the committee is concerned with the consideration of violations, including the penalties stipulated in Article 16 of the Tourism System.

The proposed amendment provides for the application of the principle of “warning” exclusively to non -grave violations, so that the violator is granted a corrective deadline to address the violation before the application of the punishment, provided that he has not repeated the commission of the same violation within one year.
The repetition of the violation – whether it is grave or unfair – is a reason for the tightening of the penalties, as the period of suspension of the permit or temporary closure doubles, provided that the total punishment does not exceed one year. The committee may also double the financial penalty for the grave violation, provided that it does not exceed the upper limit of the penalty, and in the event of the repetition of the violation four times on the same element in violations that do not include financial penalties, the committee can implement the temporary closure penalty or suspend the permit for a period of up to 60 days.

Daily fines and publication of penalties

The project authorized the consideration committee to impose a daily fine on the continuation of the violation, not exceeding 5% of the minimum fine of the violation itself, and in a total daily fine of the original minimum.
He also authorized the text committee in its punitive decisions to publish the resolution operative at the expense of the violator, in a newspaper issued at his residence or in the nearest region, or through another appropriate means, after the legal decision is fortified or the issuance of a final ruling in it.

Financial fines: from 500 riyals to one million riyals

The amendments included a number of violations classified according to varying degrees of risk, and they have put financial fines starting from 500 riyals and up to 15 thousand riyals, with the possibility of doubling the penalty up to five times or a maximum ceiling of one million riyals, whichever is earlier.
Among the most prominent violations of 15 thousand riyals is to enable others to use the permit, and the Ministry has identified the violations that have been set for 5,000 riyals, including practicing the activity without obtaining a permit, or after its cancellation, its completion or suspension, and prevent the inspectors from performing their tasks or not cooperating with them, and not using data or images that coincide with reality when announcing the facility, and not adhering to precautionary procedures in cases that threaten health Public safety.
The guide monitored a fine of 2,000 riyals on the lack of commitment to the ministry’s decisions and instructions, while the list of violations that fall under a fine of 1,000 riyals, such as losing one of the conditions of the permit, refraining from providing the service without a systematic justification, marketing or providing reservations outside the licensed channels, and not updating data with travel service providers, forcing the tourist to leave without following the regular procedures, and opening the unit that is occupied by the tourist without His permission, except in coordination with the competent authorities.
The ministry applies a fine of 500 riyals in the event that the service is not provided according to the permit, the not highlighting the declaration data or general instructions within the facility, the lack of use of the Arabic and English languages ​​or the Hijri and AD calendar, and the lack of clarification of the capacity when marketing the facility, not announcing the price list in both languages, the low level of hygiene or maintenance, and the collection of financial sums directly from the tourist outside the regular channels.
The same previous fine applies in the event that additional services are not announced or the tourist does not enable entering or leaving on time, or heading towards controlling the tourist market and achieving compliance.
