المملكة: 20 years of operational life and a 15% fine for delay…the most prominent regulations regulating the transport and towing of vehicles – Urgent


Acknowledged The General Authority for Transport, the executive regulations for the activity of transporting cars and towing vehicles, in a step aimed at organizing and developing the sector and raising the efficiency of services provided to beneficiaries.

The regulations aim to regulate the activity for commercial purposes, and encourage investment in it, while ensuring the highest standards of safety, security and environmental requirements.

The provisions apply to all practitioners of the activity within the Kingdom, whether they are establishments or individuals, and the regulations also prohibit Non-Saudi transportationand towing: the practice of internal “internal” transportation in the Kingdom.

Transport vehicle controls

The regulations set clear controls for transportation vehicles, such that their capacity does not exceed a maximum of two vehicles, and towing vehicles with only one vehicle.

The regulation obliges establishments wishing to practice the activity to obtain a valid license from the Authority, by fulfilling several conditions, including a commercial register that includes the activity, and valid certificates. For social insurance and zakat, and providing a designated center for practicing the activity.

The regulation also required the establishment to own at least one vehicle registered as “public transport”, and to connect to the authority’s electronic platform and provide a means of communication to serve the beneficiaries.

Regulating the work of individuals

In a prominent step to regulate the work of individuals in this sector, the regulation considered the “operation card” issued to the individual as a license for him to practice the activity, provided that he is of Saudi nationality.

The regulation limited the work of the individual. With only one vehicle, it was required that the vehicle be owned by him “directly or through financial lease” and registered as “public transport”, with the obligation to obtain a driver’s card, valid insurance, and adherence to the external ID approved by the Authority.

With regard to vehicles, the regulations stipulated that the operational age of the vehicle used in the activity should not exceed 20 years from the year of manufacture.

It required that it be equipped with warning emergency lights, transport and towing systems that conform to Saudi standard specifications, and provide tools. Basic safety such as a fire extinguisher and a first aid bag, in addition to installing approved protection barriers.

Controls have been tightened on drivers, as each driver must obtain a “driver card”, the issuance of which requires an appropriate driver’s license and a clean-sheet certificate.

For non-Saudi drivers, the regulations stipulate that the profession registered in the resident’s identity must be identical to the professions approved for the activity.

Transfer document

And to guarantee the rights of all parties, The regulations require the service provider to issue a “transportation document” for each operation.

The document must include the data of the sender and addressee, an accurate description of the apparent condition of the transported vehicle, and specify the transportation fee, and the agreed upon place and time of delivery.

The regulation stipulates clear mechanisms for compensation, whereby the service provider is responsible for the vehicle from the time it is received until it is delivered to the addressee.

If the service provider is late in delivering the car beyond the date specified in the document, he has the right to The customer is required to pay a late fine amounting to 15% of the value of the transportation fees for each day of delay, provided that the total fine does not exceed the value of the transportation or towing fees.

To ensure road safety, the regulations set a limit on driving hours, so that they do not exceed 9 hours per day, and can be extended to 10 hours twice a week.

It also sets the maximum weekly driving limit at 56 hours, and obliges drivers to take compulsory rest periods, such as stopping for 45 hours. One minute after every 4.5 hours of continuous driving, and get a daily rest of no less than 11 continuous hours.
