"OpenAI" Failed to register its name as a trademark in the European Union

BRUSSELS, 16 JULY / WAM / OpenAI, the company that owns the “GBT Chat” program, has lost its appeal against the European Union’s refusal to register its name as a trademark.
The American company was seeking to cancel a decision issued by the European Union Intellectual Property Office, which had agreed to register its logo as a trademark, but refused to register its name.
The European Union Intellectual Property Office ruled that the combination of two common words in the English language, “open” (open) and “AI” (artificial intelligence), can describe many commercial activities in the field of artificial intelligence.
EU rules do not allow the registration of trademarks that limit themselves to describing a specific product or service because that would mean that competitors would be prohibited from using these terms in their advertising. An exception is made for companies that can prove that they have been using their name for a long time.
