Dubai’s distinction establishes the principle of finality of the rulings of the Emirates Sports Arbitration Centre

Dubai, 8 November / WAM / The Emirates Sports Arbitration Center announced the issuance of a ruling by the General Authority of the Dubai Court of Cassation, declaring that it is not permissible to file an invalidation lawsuit against the rulings issued by the Center for all disputes filed before its chambers of first instance and appeal, in a judicial precedent that strengthens the status of sports arbitration in the UAE.
The ruling of the Court of Cassation in Dubai is based on the fact that the rulings of the Emirates Sports Arbitration Center are final, binding, and not subject to appeal, and have the status of an executive document, and it is not permissible to file a lawsuit to invalidate the Center’s arbitration award before the courts, or to object to the arbitration award except before the enforcement judge through a substantive enforcement lawsuit.
His Excellency Jamal Hamid Al Marri, President of the Emirates Center for Sports Arbitration, pointed out that this ruling represents an important qualitative leap and a historic step in the process of sports arbitration at the state level, and consolidates the position of the Center and its exclusive jurisdiction in adjudicating sports disputes.
He appreciated the ruling of the Dubai Court of Cassation, stressing that the UAE will remain a beacon of complete justice and a model to be emulated in all legal and judicial fields, in a way that achieves equality for all and ensures that every member of the sports system is given his due.
He stated that this ruling is the culmination of careful legislative and regulatory efforts that established the principle of independence of UAE sports arbitration, and confirmed the soundness of the legislation and procedural rules governing the work of the Emirates Sports Arbitration Centre.
