المملكة: Water Regulation Amendments: Postponing the obligation until 2027 and companies monitoring water abuses
A ministerial decision approved a decisive amendment to the executive regulations for monitoring and compliance with efficiency standards and Ministerial Resolution No. “25207748” issued on 2 Ramadan 1446 AH corresponding to March 2, 2025 AD regarding strategic updates in Water Sector.
Mandatory Implementation
The amended text clarified that the cover of the regulation was changed to postpone the mandatory implementation of version “2.0” to Shawwal 13, 1448 AH, corresponding to March 21, 2027 AD, instead of the previous date in the year 1447 AH.
The amendments indicated a fundamental addition to Article Three, which stipulates the authorization of the National Center for Efficiency and Rationalization. Water “Water” is responsible for controlling and investigating violations of the executive regulations.
Regular procedures
The amendment indicated that this authorization came based on Ministerial Resolution No. “15154582” dated 8/3/1447 AH, granting the center the authority to take all regulatory measures regarding violations.
The amended regulations indicated in its eleventh article an advanced step to enhance the efficiency of oversight.
The center was given the opportunity to seek the assistance of “specialized companies or offices” to carry out the tasks of careful monitoring and controlling water violations.
Regulatory update
The regulatory update touched on the mechanism of dealing with perpetrators of violations in modern ways that keep pace with digital transformation.
The amendments stressed the conduct of investigations with the person responsible for the violation or the person authorized to do so, and hearing their statements and defense via “electronic means.”
Flexibility. Procedural
The regulations added procedural flexibility that enables the Center to use any method it deems appropriate to enable it to effectively perform its tasks and responsibilities in investigating everyone related to the violation.
At the conclusion of the amendments to Article Fifteen, the regulations were approved immediately after they were “published” in the Official Gazette, thus canceling the previous link to its effective date.
